#Wyoming, #Giustizia: La Corte Suprema del Wyoming ha dichiarato incostituzionale il divieto (ban) quasi totale di aborto e di aborto farmacologico.
Lo Stato ha approvato tali misure nel 2023, l’anno dopo il ribaltamento della sentenza Roe v. Wade. La prima misura era il divieto quasi totale all’interruzione volontaria di gravidanza, fatti salvi i casi di incesto, violenza sessuale e quelli in cui la vita della gestante fosse a rischio.
Successivamente, è diventato il primo Stato degli USA a mettere fuorilegge la pillola abortiva.
Nonostante le leggi, però, l’aborto è rimasto possibile poiché i tribunali ne hanno sospeso l’efficacia in attesa delle pronunce definitive.
Pronunce che sono arrivate oggi: la Corte Suprema del Wyoming ha dichiarato che i divieti violano la Costituzione dello Stato, che garantisce il diritto di una donna di poter decidere delle proprie prestazioni sanitarie.
Secondo lo Stato, l’aborto non è una prestazione sanitaria e, anche se lo fosse, non dovrebbe essere considerata una decisione della gestante in quanto interrompe la vita del feto.
Una ricostruzione che non ha convinto la Corte: “Sebbene la decisione della donna abbia un impatto e ponga fine alla vita del feto, la decisione è, alla fine, una decisione che lei può prendere sulla propria salute”.
Il Governatore Mark Gordon (R) ha criticato la decisione e ha invitato la Legislatura statale ad approvare un emendamento costituzionale sull’aborto il prima possibile.
