🇺🇸 AI Police Reports With No Trace
A new investigation by the Electronic Frontier Foundation reveals that Axon's AI tool, "Draft One", used to generate police reports from bodycam audio, is deliberately designed to erase its own footprints. No drafts are saved, no AI-generated sections are marked, and departments retain no version history — making oversight functionally impossible. This absence of auditability means it's unclear whether officers are genuinely reviewing the reports or just rubber-stamping them.
The implications are serious: if a report contains biased language or factual inaccuracies, no one can determine whether the AI or the officer is responsible. In at least three instances, bugs allowed officers to bypass safeguards and submit AI drafts without review. As the EFF puts it, this creates a “smokescreen” that could help law enforcement evade accountability in court — all under the guise of technological progress.

🇺🇸US Senate Advances Civil Liability for Nonconsensual Deepfake Porn
The U.S. Senate has passed the DEFIANCE Act (Disrupt Explicit Forged Images and Non-Consensual Edits Act), which would give victims of nonconsensual deepfake pornography the right to sue those who produce or distribute such content. The bill previously cleared the Senate but stalled in the House; its latest passage marks another step in Congress’s response to AI-enabled image abuse.
The legislation follows earlier federal action, including the TAKE IT DOWN Act signed into law last year, and reflects growing concern over the scale of harm. According to cited research, the number of nonconsensual deepfake porn videos online has increased ninefold since 2019. Senator Dick Durbin emphasized the severe personal and social consequences for victims and highlighted bipartisan work with Representative Alexandria Ocasio-Cortez, herself a target of explicit deepfakes.
If enacted, the DEFIANCE Act would add a private right of action to the regulatory toolkit, shifting part of enforcement to civil courts and increasing legal exposure for creators and platforms involved in distributing nonconsensual AI-generated sexual content.

🇫🇷France Opens Criminal Probe Into Grok-Generated Sexual Deepfakes
French prosecutors have expanded an existing investigation into X to cover the spread of non-consensual sexually explicit deepfakes generated by Grok, the AI system integrated into the platform. According to the Paris prosecutor’s office, thousands of images depicting women and teenagers “undressed” by AI were created at users’ request and published on X. The offense carries potential penalties of up to two years’ imprisonment and a €60,000 fine.
Lawmakers Arthur Delaporte and Eric Bothorel formally alerted authorities on January 2, arguing that the AI-generated montages violate the dignity of those depicted. Three French ministers reported the content to prosecutors and to Pharos, the government’s online monitoring platform, seeking immediate removal.
xAI acknowledged “isolated cases” in which users obtained AI images of minors in minimal clothing, stating that safeguards exist but are still being improved to block such requests entirely. X did not respond to media inquiries at the time of publication.

California Takes a Stand: New Bill to Protect Performers from AI Replicas
The California Senate has approved AB 2602, a groundbreaking bill requiring explicit consent from performers before creating digital replicas of their likeness across TV, film, video games, audiobooks, and commercials. This legislation represents a significant victory for SAG-AFTRA in its ongoing battle against unauthorized AI use in the entertainment industry.
Duncan Crabtree-Ireland, SAG-AFTRA's executive director, hailed the bill as "a huge step forward" in establishing safeguards against potential licensing abuse. While this marks a critical development, the bill still awaits Governor Gavin Newsom’s signature to become law. If enacted, it could set a new standard for AI ethics and performer rights, reflecting California’s leadership in balancing innovation with human protection.

Empowering Civil Society: Key Actions for AI Act Enforcement
A recent report by the European AI & Society Fund, conducted by the European Center for Not-for-Profit Law (ECNL), underscores the critical role of civil society in shaping the enforcement of the AI Act. The next few months present a strategic window for civil society organizations (CSOs) to advocate for public interest and the protection of fundamental rights. Key priorities include ensuring strict bans on harmful AI systems, addressing systemic risks associated with products like ChatGPT, and limiting exemptions in sensitive areas such as national security and migration.
Drawing lessons from the European Digital Services Act (DSA), the report highlights that civil society can effectively influence the implementation of laws and hold companies accountable. To maximize impact, CSOs need coordinated engagement with institutions like the AI Office and the European Data Protection Supervisor. Additionally, they must build research capacity, technical expertise, and legal analysis grounded in fundamental rights to advocate effectively on critical issues such as prohibitions, risk designations, and exemptions.

USA: Senate Bill Targets AI Deepfakes and Protects Content Creators
A new bipartisan bill, the Content Origin Protection and Integrity from Edited and Deepfaked Media (COPIED) Act, has been introduced in the Senate to establish federal transparency guidelines for AI-generated content, including deepfakes. This legislation mandates AI companies to embed origin data into generated content and prohibits the removal or tampering of this information, ensuring content creators can detect unauthorized use of their work.
The COPIED Act aims to provide robust legal protections for content creators such as journalists, artists, and musicians, allowing them to safeguard their intellectual property and dictate terms of use. By requiring AI providers to include provenance metadata, the bill ensures that rightsholders can trace and address unauthorized utilization of their content. Additionally, the Federal Trade Commission (FTC) and state attorney generals will enforce these regulations, with content owners retaining the right to sue for unauthorized use.

YouTube Empowers Creators: AI Training Opt-In
YouTube is giving content creators more control over how their videos contribute to AI development. A new “Third-Party Training” setting allows creators to explicitly authorize specific AI companies—currently 18 major tech players like OpenAI and Microsoft — to use their content for training generative AI models.
Importantly, a video can only be eligible if both the creator and applicable rights holders, including those identified via Content ID, provide consent. Unauthorized scraping and content access remain strictly prohibited under YouTube’s Terms of Service.
This marks a pivotal step toward balancing AI innovation and creator autonomy, as YouTube explores further collaborations between creators and AI developers.

Protecting Freedom of Expression within the AI Act Framework
In a recent op-ed for Tech Policy Press, Jordi Calvet-Bademunt, Senior Research Fellow at The Future of Free Speech, delves into the AI Act’s potential impact on freedom of expression. With new requirements for assessing and mitigating systemic risks tied to high-impact AI, the Act aligns with the Digital Services Act (DSA) approach but introduces significant challenges. Providers of general-purpose AI now face complex responsibilities in balancing various fundamental rights. A misstep in judgment may lead to excessive content removal, as companies seek to avoid potential penalties—a trend that could inadvertently curb free speech, particularly for contentious viewpoints.
As the European Commission prepares to enforce the Act, concerns are rising about the role of political influence in managing what constitutes "public security." Past examples, like then-Commissioner Breton’s statements advocating platform shutdowns during unrest, underline the risks associated with broad regulatory powers. The upcoming General-Purpose AI Code of Practice, set to accompany the Act, presents a vital opportunity for establishing protections that better secure freedom of expression.
