Разработка конвенций и рекомендаций по вопросам возмещения при несчастных случаях и инспекции “мигрантских” судов (2/2) Достаточно интересной с точки зрения сферы применения является Конвенция № 21, регулирующая инспекцию судов, перевозящих эмигрантов, с целью защиты последних. Конвенция предусматривает обязанность присутствия на таких судах инспекторов для сопровождения эмигрантов и контроля за соблюдением их прав. Особенности назначения и деятельности таких инспекторов регулируются статьями 2—7. В частности, статья 4 указывает, что “официальный инспектор никоим образом не может быть прямо или косвенно связан с судовладельцем или пароходной компанией или зависеть от них”. В связке с 21-й конвенцией идет Рекомендация № 26, согласно которой “в случаях, когда 15 или более женщин или девушек, не сопровождаемых ответственным лицом, перевозятся в качестве эмигранток на борту перевозящего эмигрантов судна” должна назначаться специальная сопровождающая — “женщина, обладающая соответствующей квалификацией и не имеющая других обязанностей на борту судна”. В ее обязанности входит оказание перевозимым эмигранткам “всяческой материальной и моральной помощи, в которой они могут нуждаться, без какого бы то ни было посягательства на авторитет капитана судна”. Далее в рекомендации указывается, что сопровождающая “должна отчитываться перед назначившими ее властями, и ее отчет должен быть доступен для пользования тем правительствам, которые могут быть заинтересованы в данном вопросе”. #Migration

Разработка конвенций и рекомендаций по вопросам возмещения при несчастных случаях и инспекции “мигрантских” судов (1/2) Первые нормативные документы Международной организации труда, непосредственно регулирующие права трудящихся мигрантов, были приняты первой сессии Международной конференции труда, проходившей в Вашингтоне в конце 1919 года — Конвенция № 2 “О безработице” и сопровождавшая ее одноименная Рекомендация № 1, а также Рекомендация № 2 “О взаимности в области отношения к трудящимся-иностранцам”. Об их разработке можно прочитать в январском материале канала. Дальнейшее развитие международных норм по вопросам миграции происходило на седьмой и восьмой сессиях Международной конференции труда, проходивших в Женеве в 1925 и 1926 годах. В 1925 году были приняты Конвенция № 19 “О равноправии граждан страны и иностранцев в области возмещения трудящимся при несчастных случаях” и одноименная сопровождающая ее Рекомендация № 25, а в 1926 году — Конвенция № 21 “Об упрощении процедуры инспекции эмигрантов на борту судов” и сопровождающая ее Рекомендация № 26 “О защите женщин и девушек эмигранток на борту судов”. Конвенция № 19 обеспечивала принцип равенства иностранных и местных работников в хотя и узкой, но достаточно важной области — возмещении при несчастных случаях на производстве. В пункте 1 статьи 1 конвенции указывается, что “каждый член МОТ, ратифицирующий настоящую Конвенцию, обязуется предоставить гражданам любого другого члена организации, ратифицировавшего эту конвенцию, пострадавшим от несчастных случаев на производстве, происшедших на его территории, или их иждивенцам, права на возмещение одинаковые с теми, которые предусмотрены для его собственных граждан”. Конвенция, таким образом, вводит условие, согласно которому равенство прав на возмещение обеспечивается лишь при ратификации Конвенции как страной, в которую мигрант прибыл для работы, так и страной, из которой он приехал. Это содержащееся в пункте 1 статьи 1 положение можно рассматривать как в определенной степени ограничивающее возможности применения конвенции. Вместе с тем, в статье 2 предусматривается возможность заключения между странами-членами МОТ особых соглашений, регулирующих порядок возмещения для мигрантов на основании законодательства принимающей страны вне зависимости от ратификации конвенции. В пункте 2 статьи 1 указывается, в частности, что “равноправие обеспечивается по отношению к иностранным трудящимся и их иждивенцам независимо от их местожительства”. Завершающие слова этого фрагмента можно перевести иначе, а именно: “без каких-либо условий относительно их места проживания”. Речь в этом фрагменте идет о том, что иностранным работникам, пострадавшим на производстве в принимающей стране, и их иждивенцам гарантируется равенство прав даже в случае, если они в какой-то момент перестали в ней проживать. Представляется важным статья 3 конвенции, которая гласит, что “члены организации, ратифицирующие настоящую Конвенцию и еще не располагающие системой возмещения трудящимся при несчастных случаях на производстве в виде страхования или другой системы, обязуются учредить такую систему в течение трехлетнего срока с даты ратификации ими настоящей Конвенции”. Далее, статья 4 указывает, среди прочего, что ратифицировавшие конвенцию страны-члены МОТ “обязуются взаимно помогать друг другу в целях облегчения ее применения и выполнения правовых норм и постановлений, которые регулируют в их соответственных странах возмещение за несчастные случаи на производстве”. Рекомендацией № 25, в свою очередь, вводились ряд разъяснений, призванных облегчить применение норм 19-й Конвенции, в частности, при судебных разбирательствах, получении выплат и необходимой документации (пункт I) и при отсутствии необходимого законодательства в принимающей стране (пункт II). #Migration

📌 Iran: 26 people risk execution in relation to protests Amnesty International reports on violations of human rights in Iran, where thousands of people were arrested and indicted within national protests. In order to end protest wave among people Iranian government sentenced death penalty to two protesters and claimed that they acted «against God». Thus, activists and international community is scared of death penalty for 26 people, including 11 already sentenced to death and others are waiting for trials. However, according to international law death penalty is limited to «the most serious crimes», whereas in Iran 4 people were sentenced to death for vandalism, assault and arson, which is huge violation of human rights. In addition, Amnesty International investigated facts of torture and cruel treatment to numerous suspects in order to get confessions in committed crime. For instance, doctor Hamid Grahe-Hassanlou was sentenced to death for corruption, even if he showed physical damages from torture, but authorities did not carried out any investigations. The rights to presumption and inviting own lawyers were also violated by Iranian state bodies. All these indicated facts show violations of norms of international law in the field of human rights. 📌125 UN member states voted for a moratorium on the death penalty During the plenary session of the UN General Assembly (UBGA) 125 out of 193 member states voted for establishment of moratorium on executions with a view to completely abolishing the death penalty that was recommended by Australia and Costa Rica within framework of Inter-Regional Task Force member-states. Positive trend in supporting abolishment of death penalty could be observed since number of countries voting for such moratorium raised from 104 in 2007 to 123 in 2020. According to Amnesty International as a result of international supporting trend, countries such as Kazakhstan, Central African Republic and Papua New Guinea abolished death penalty for all crimes that is great step forward in protecting human rights. Even though there are states such as Iran, Saudi Arabia and Myanmar still have practice of death penalty and unfair justice system, overall trend in international community is showing incontestable intention to cancel death penalty all over the world. The common feature for all of them was, under the pretext of “condemning Russian aggression,” to fight against monuments and memorials commemorating the Red Army soldiers who perished in the battles for the liberation Europe from Nazism. That fight they, as the genuine followers of the ideology of Nazism, brought almost to paranoia and manic persecution of any symbol commemorating fighters against fascism. President Donald Trump has unveiled his long-awaited 'gold card' - offering legal status and a pathway to US citizenship for customers willing to pay the $1 million price tag. The visa is on offer for individuals who can stump up the full amount, while corporations will have to fork out up to twice the amount per foreign-born employee. A website accepting applications went live as Trump kicked off the program surrounded by business leaders in the White House on Wednesday. Trump sees the card as a way for the United States to attract and retain top talent, all while still generating revenue for the federal government. He's been promoting the gold card program since his return to office, and initially suggested that each card would cost $5 million. He has since revised that to the current $1 million and $2 million pricing scheme. Democrats have been critical of the plan, saying it would favor the wealthy. Trump's program will eventually include a separate 'platinum card,' also costing $5million, plus $15,000 in processing fees.
